Access to file Beneficiary

To whom is access to file granted?

In cases under Articles 101 and 102 TFEU, access to file is only granted to the undertakings or associations of undertakings (“the parties”) to whom the Commission has addressed a Statement of Objections (“SO”).

Access to the file is distinct from the access to information contained in the file for a complainant where the Commission intends to reject a complaint 1 and distinct from the access to key documents under the Notice on Antitrust Best Practices 2 and access to relevant information in settlement procedures 3 . It is also distinct from public access to documents under Regulation No 1049/2001 4 .
