Where there is an intention to adopt an Article 10 decision, pursuant to Article 27(4) of Regulation 1/2003, the Commission must publish a concise summary of the case and the main content of the proposed course of action (Article 27(4) Notice).

Interested third parties may submit their observations within a time-limit which is fixed in the publication. That time-limit may not be less than one month.

The decision to publish a summary of the case pursuant to Article 27(4) is taken by the Commissioner responsible for competition by empowerment.

Other Considerations

The Article 27(4) Notice is not a decision which can be the object of an action for annulment (Article 263 TFEU) 1 .
